Choosing the Right DEA Consultant is Extremely Important: 6 Things to Know (Follow Up)

How do I choose a DEA Consultant?

When it comes to DEA compliance, selecting the right consultant is critical. The wrong choice can lead to unnecessary costs, ineffective inspections, and even regulatory trouble. Here’s how to evaluate a DEA consultant to ensure you’re getting the expertise you need—without overpaying.

DeKo Law previously published a post titled, ‘DEA Consultants: When to Use Them, How to Find the Good Ones, and How to Avoid the Bad Ones.’ Following its release, I received a significant number of questions, and below I’ve addressed the most common inquiries.

Cost Expectations

DEA consulting services can be expensive, but there are reasonable limits:

  • Top-tier DEA consultants should not charge more than $500 per hour.
  • If a consultant is charging this rate, they should have exceptional qualifications and experience. Below are the credentials that justify such a fee.

Required Experience for High-Level DEA Consultants

Not all former DEA employees are equally qualified for consulting roles. Here’s what to look for:

  • Diversion Investigator Background: The consultant must have served as a DEA Diversion Investigator—not just as a Special Agent. Special Agents typically do not conduct regulatory inspections or diversion investigations.
  • Field Experience: At least 10 years of field experience in diversion control is essential.
  • Supervisory Role: A minimum of 3 years as a Group Supervisor overseeing diversion investigations.
  • Headquarters Experience: Time spent at DEA Headquarters working on policy development or regulatory drafting is a strong indicator of deep expertise.

Subcontractor Use: What to Ask

Some consultants outsource inspections to subcontractors. If this is the case, you should:

  • Ask if subcontractors are used for onsite inspections.
  • Request the subcontractor’s resume and verify they meet the same qualifications listed above.
  • Ensure they were a Diversion Investigator for at least 15 years, with direct experience conducting regulatory inspections.
  • Avoid subcontractors who were only Special Agents, as they typically lack the necessary regulatory experience.
  • Speak directly with the subcontractor before agreeing to the engagement.

Typical Costs by Registrant Type

To help you budget appropriately, here are standard cost ranges for common registrant types:

  • Retail Pharmacy (Standard Size)
  • Cost: Up to $15,000
  • Includes: On-site inspection and a comprehensive written report.
  • Practitioner’s Office (Standard Size)
  • Cost: Up to $10,000
  • Includes: Onsite inspection and a detailed report.

Red Flags to Watch For

When evaluating DEA consultants, be cautious of the following:

  • Overpriced Services Without Matching Experience
  • A high fee should be backed by substantial, relevant experience—not just a prestigious title or past affiliation with the DEA.
  • Misplaced Focus on Security Over Records
  • Be wary of consultants who emphasize expensive security upgrades while neglecting your recordkeeping practices.
  • DEA fines are primarily based on recordkeeping violations, not physical security issues.

Final Thoughts

Choosing the right DEA consultant can make all the difference in your compliance strategy. Don’t settle for flashy titles or inflated fees—look for real experience in diversion investigations, regulatory policy, and field supervision.
